Touch The Sky Psychology (ABN: 17 523 854 571) is committed to protecting the privacy of your personal and sensitive information in accordance with the legal requirements of the Australian Privacy Principles set out in the Privacy Act 1988 (Cth), as well as other relevant state laws that apply to the management of personal and sensitive information.

This document sets out how Touch The Sky Psychology collects, uses, manages, stores, and discloses the personal and sensitive information of visitors to our website, prospective clients, users of services we provide, and clients. This applies to our website and the products/services we provide, and should be read in conjunction with our Terms of Service. By using our website, products, and/or services, you are agreeing to the terms of our Privacy Policy.
What information do we collect about you?
To provide services to you, we need to gather personal and sensitive information about you, including (but not limited to) medical, psychological and other allied health reports, school records and reports, referral letters, medication history, health and developmental history, and other important information. We may also ask to collect identifying information, including Medicare details, credit card and bank account details, and details of third parties involved in the management or funding of your appointments to support payment of services. This information is necessary in the delivery of psychological assessment and treatment services.
How do we collect your information?
There are a number of ways we might collect your personal and sensitive information, including:

directly from you in person or via phone, email, or if you send us information through our website or practice management software (Halaxy), and

from other sources, including your GP, allied health professionals, government agencies administering your entitlements and benefits, parents/caregivers, teachers/educators, legal professionals or a person responsible for your healthcare decisions when appropriate.
Our website and services may collect other information, including IP addresses, browser type, and other information relating to the device used to access the website.​
How we store and protect your information
Touch The Sky Psychology takes reasonable steps to protect your personal and sensitive information from misuse, loss, unauthorised access and modification or disclosure. We use commercially available, administrative and physical measures to protect personal and sensitive information that we hold, and:

ensure physical security over paper and electronic data stores, such as locks and security systems, is maintained and monitored regularly,

maintain security systems, by using a firewall, using strong passwords and encryption to control access to electronic devices and systems, and using two-factor authentication when available to access electronic systems,

take reasonable steps to destroy and de-identify your personal and sensitive information once it is no longer needed, and
-
conduct regular privacy and data security audits to assess whether we have adequately complied with and implemented these measures.

Unfortunately, no data security system can guarantee 100% security all the time. The security of the information transmitted to us via the internet cannot be guaranteed. If you choose to send us information online, you do this at your own risk. Wherever possible, we recommend sending us information through our practice management system, Halaxy, which has its own inbuilt security measures.

You are responsible for protecting any passwords or account information relating to apps, software, platforms or services used through the services you access with Touch The Sky Psychology.

Your information may be stored electronically through third party data centres located overseas (that to the best of our knowledge comply with Australian legislation) or in physical storage at our premises. When services are completed, we convert all client files into electronic format and store them online via our secure practice management software (Halaxy). Once digitised, hard copies of documentation are shredded and disposed of securely.
Why we collect your information
We collect your personal and sensitive information for a number of reasons, including (but not limited to):

to assess whether we are an appropriate service for you,

to provide you with psychological services such as assessment and diagnosis and/or preparing reports and other written documentation,

to send you communication via SMS or email, to remind you about your appointments, send invoices, and to provide you with questionnaires and reports/documentation,

to ensure you receive the correct entitlements to benefits and funding for our services from third-party payers, as well as to comply with their requirements as needed,

to respond to your enquires, requests, and feedback, and
-
to keep your information up to date and when updating records.
Disclosure of your information
Your personal and sensitive information will remain confidential except when:

it is subpoenaed by a court, or disclosure is otherwise required or authorised by law; or
-
failure to disclose the information would in the reasonable belief of Touch The Sky Psychology place you or another person at serious risk to life, health or safety; or
-
your prior approval has been obtained to:
a. provide a written report to another professional or agency, e.g., a GP or a lawyer; or
b. discuss the material with another person, e.g., a parent, employer or health provider; or
c. disclose the information in another way; or
d. disclose to another professional or agency (e.g., your GP) and disclosure of your personal information to that third party is for a purpose which is directly related to the primary purpose for which your personal information was collected.

Your personal and sensitive information is not disclosed to overseas recipients, unless you consent or such disclosure is required by law. Your personal and sensitive information will not be used, sold, rented or disclosed for any other purpose.
Mandatory Reporting
Mandatory reporting is the legal requirement for certain professional groups to report a reasonable belief of child physical or sexual abuse to child protection authorities. In Victoria, psychologists are listed as mandatory reporters. This means that psychologists are legally obligated to make a report to child protection if they form a reasonable belief that a child is at risk of significant harm and is in need of protection, with or without informing you and/or seeking your consent.
Telehealth
We have chosen to use Microsoft Teams for Telehealth sessions provided by Touch The Sky Psychology, which is compliant with the Australian standards for online security and encryption. For your privacy and confidentiality, sessions will not be audio and/or visually recorded by us, and we ask that you also do not record them (unless this is discussed with the psychologist prior to your session). Requirements for Telehealth services are detailed in our Terms of Service.
Consequence of not providing your personal information
If you do not wish for your personal and sensitive information to be collected in any way anticipated by this Privacy Policy, or the information you provide is incomplete or inaccurate, Touch The Sky Psychology may not able to provide you with the services you seek. In some cases, you may request to be anonymous or to use a pseudonym, unless it is impracticable for Touch The Sky Psychology to deal with you, or if it is required or authorised by law to deal with identified individuals.
If you have any queries about the personal and sensitive information you are asked to provide, please ask for clarification from your psychologist.
Access to your information
At any stage, clients may request to see and/or correct the information kept on file. Your psychologist may discuss the contents with you and/or give you a copy, subject to the exceptions in privacy laws.
If it is determined that your information is inaccurate, out of date or incomplete, reasonable steps will be taken to ensure that this information is corrected. All requests by clients for access to or correction of information held about them should be lodged, in writing, via email (info@touchtheskypsychology.com). These requests will be responded to in writing within 30 days, and an appointment (billed at the current sessional rates and payable by you) will be made if necessary for clarification purposes.
Separated parents
In cases where both parents/guardians have legal responsibility for a child, they are both able to request and access information about the psychological services provided by Touch The Sky Psychology. During the intake process and/or prior to services being provided, we request that a copy of any court orders be provided to clarify who has legal responsibility for the child.
Social contact
If you and/or your child see your psychologist out in the community (e.g., at a shopping centre, at school), your privacy and confidentiality will be respected. Your psychologist will not initiate contact and will be guided by your preferences for interaction. Should contact be made by you and/or your child, the interaction will be kept brief, and conversations will be redirected should you and/or your child start to share personal or sensitive information. This is to protect your privacy and confidentiality.
Marketing
Occasionally we may send promotional emails with information regarding our services and updates to the terms/services, as well as details of new services. Your personal information will never be provided to other organisations for the purposes of direct marketing. You can contact us via email at any time should you wish to stop these promotional emails. If you receive communications from us that you believe conflict with this privacy policy, or are in breach of the law, please contact us.
Changes to this privacy policy
This privacy policy will be updated when our information handling practices change. Your personal and sensitive information will consistently be governed by the most current privacy policy. We suggest you periodically review our Privacy Policy for any changes.
